Terms of Service
1. Scope
These Terms govern the contract between Soraka (Onur Kağan) and you (Customer) for:
- Pre-order and purchase of the Soraka OBD-II diagnostic adapter
- Use of the Soraka application (iOS / Android)
- Access to cloud services (optional)
By filling out the pre-order form or downloading the app, you accept these Terms. Conflicting terms from the customer are not recognized unless Soraka expressly agrees in writing.
2. Subject Matter
2.1 Hardware
Soraka is a portable OBD-II diagnostic device (CAN / K-Line adapter) that connects to your vehicle's standardized diagnostic port (OBD-II). Function: read real-time engine control unit (ECU) data, display fault codes (DTC), monitor vehicle sensors.
2.2 Application
iOS and Android app for viewing and managing vehicle diagnostic data via Bluetooth Low Energy (BLE).
2.3 Backend and Cloud (optional)
Optional cloud sync service. Base data is stored locally on your device.
3. Contract Formation, Pricing, Delivery
Product listings on www.soraka.de are not binding offers but an invitation to make an offer. Submitting your order constitutes a binding purchase offer. Acceptance occurs through order confirmation email or shipment of goods.
Pricing: All listed prices are final prices in Euro (EUR). As a small business under § 19 UStG, VAT is not shown.
Shipping: Shipping costs and estimated delivery times are shown transparently during checkout. [Standard delivery time, carrier and shipping cost to be finalized].
Payment methods: [Stripe / SEPA / PayPal — to be confirmed after backend setup]. Payment is due upon order completion.
4. Account and Registration
- Registration required? No. The app works with BLE pairing alone.
- Optional account: Cloud sync requires registration (email + password).
- Age: You are at least 18 years old or have parental consent.
- Responsibility: You are solely responsible for your account and must keep your password secure.
5. Disclaimer and Liability
5.1 Not a Substitute for Professional Maintenance
Soraka is not a substitute for a certified mechanic. The app displays real-time data, OEM fault codes (DTC), and an estimated "health score" — a prognosis, not a diagnosis. Fault codes are hints: a "Catalyst efficiency low" DTC can also result from a sensor, wiring, or control unit issue.
5.2 No Repair Service
Soraka does not provide repairs or reconditioning. Consult a certified workshop before expensive repairs.
5.3 Liability Limitation
Soraka is liable without limit for intent and gross negligence and for injury to life, body or health. For simple negligence, Soraka is liable only for breach of essential contractual obligations (cardinal duties); in that case liability is limited to the typical foreseeable damage. Otherwise, liability is limited to the purchase price. Liability for lost profits, indirect or consequential damages is excluded to the extent permitted by law.
6. Intellectual Property
- App code, logos, design: All rights reserved by Soraka. You receive a simple, non-transferable license for private use.
- Your vehicle data: You own your sensor data and VIN.
- Community contribution (optional): By sharing data to the leaderboard, you grant Soraka the right to publish aggregated statistics (not raw data).
7. Prohibited Uses
You may not use Soraka for:
- ECU remapping / tuning: Changing engine parameters without manufacturer approval voids vehicle warranty and is illegal in many jurisdictions.
- Odometer manipulation: Rolling back mileage is fraud under § 263 StGB.
- Vehicles not yours: Use without explicit written owner permission.
- Illegal purposes: Circumventing emissions standards, manipulating inspections, etc.
Violations may result in warranty loss, account suspension, and damages claims.
8. Warranty
8.1 Statutory Warranty
The statutory warranty applies for 2 years from delivery (BGB §§ 437 ff., § 438). For defects, contact onurkagaan@gmail.com with photos and test results. Soraka offers, at its choice, repair or replacement.
Excluded: normal wear and tear, damage from accidents, drops, heat, moisture, unauthorized opening or modification, and intentional or grossly negligent misuse.
8.2 App
The app is provided "as is". Bugfixes are provided where reasonably possible; no specific availability is guaranteed.
9. Consumer Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party indicated by you (other than the carrier) acquires physical possession of the goods.
To exercise your right of withdrawal, you must inform us (Soraka, Onur Kağan, onurkagaan@gmail.com) of your decision by an unambiguous statement (e.g., a letter sent by post or an email). You may use the model withdrawal form below, but it is not mandatory.
Effects of withdrawal: If you withdraw, we will reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery type other than the cheapest standard delivery offered), without undue delay and no later than fourteen days from the day on which we receive your withdrawal notice. We will use the same payment method as for the original transaction.
You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
Model withdrawal form: "I/we hereby give notice that I/we withdraw from my/our contract of sale of the following goods: …, ordered on …, received on …, name, address, date, signature (only if notified on paper)."

11. Changes
Soraka may update these Terms. Material changes will be announced at least 30 days in advance via email or website notice. If you do not object within 30 days of notification, changes are deemed accepted; this consequence will be pointed out in the notice.
12. Governing Law, Jurisdiction, ODR
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection law of your country of residence remains unaffected.
Jurisdiction: If you are a merchant, legal person under public law, or special fund under public law, the place of jurisdiction is the seat of Soraka ([city, pending registration]).
Online Dispute Resolution: EU Commission platform: ec.europa.eu/consumers/odr. Soraka is neither willing nor obliged to participate in dispute resolution before a consumer arbitration body.
13. Severability
Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
